Terms of Service

These Terms of Service (“Terms”) govern your use of ThinkCanvas (the “Service”), operated by Mok Ching Wang, an individual based in Hong Kong (“we”, “us”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service.

2. The Service

ThinkCanvas is an AI-assisted visual canvas. The Service is provided on an “as-is” basis and is under active development; features may change, be added, or be removed, and the Service may be interrupted or discontinued at any time.

3. Your account

You are responsible for the activity under your account and for keeping your credentials secure. Notify us promptly of any unauthorized use.

4. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose or to create unlawful, infringing, or harmful content;
  • attempt to disrupt, overload, or gain unauthorized access to the Service;
  • scrape, reverse-engineer, or attempt to extract the source code of the Service except as permitted by law;
  • resell or misrepresent the Service.

5. Your content and intellectual property

You retain ownership of the content you create in the Service (“Your Content”). You grant us a limited, worldwide, non-exclusive license to host, store, process, and display Your Content solely to operate and provide the Service to you. We do not claim ownership of Your Content.

6. AI output

The Service uses AI to generate content. AI output may be inaccurate, incomplete, or misleading, and is provided without warranty. You are responsible for how you use AI output, and you should not rely on it for professional, legal, medical, financial, or other consequential decisions without independent verification.

7. Third-party services

The Service relies on third-party providers, including third-party AI providers that process your prompts and board content to generate responses. Your use of those features is also subject to those providers’ terms. See our Privacy Policy for how data is shared.

8. Privacy

Our Privacy Policy explains how we handle your information and forms part of these Terms.

9. Paid plans

Paid plans are not currently offered. Separate billing terms will apply when paid features are introduced.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service or other users.

11. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement, to the maximum extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service.

13. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the Service or your breach of these Terms.

14. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts of Hong Kong.

15. Changes to these Terms

We may update these Terms from time to time. We will revise the “Last updated” date above, and your continued use of the Service constitutes acceptance of the updated Terms.
